Riverhunters Begin Court Battle Five Uvalde men went to court last Tuesday Nov. 27 to fight a Texas Parks and Wildlife Department proclamation that states it is illegal to hunt in the riverbeds of Uvalde County. Raymond Scott, Clifford Joe Scott, H. H. Willis, Kyle Whidden, and Ray Lemke all were found guilty of violating that law and fined $28.50 each. The men who are all members of the Uvalde County Sportsman Association said they would be appealing their case to the criminal court of Appeals in Austin. Attorney Rogelio Munoz was the lawyer for the defendants and Uvalde County Attorney David White Jr. was the prosecuting attorney. The only two witnesses called to the stand were State Game Warden Bill Waldrop and Deputy Game Warden Don Frietag. Waldrop was the officer who filed the citation on the men and Frietag accompanied Waldrop when the men were caught hunting dove on the Frio River half mile south of the Garner Field crossing on the evening on Sept. 16, 1979. Frietag is not a state officer. He is paid for his duties by a group of ranchers in Uvalde County. He does have power to make arrests of game and fishing violators in four counties including Uvalde. Twenty four possible jurors were interviewed before the remaining six were selected. Those struck out by the attorneys had very clearly stated either they were against the proclamation and believed the rivers should not be closed for hunting, or on the opposite side saying they did not want river hunting to be permitted. It took the jury of four women and two men only some 15 minutes to decide on their verdict. The case was very significant in that it brings to light the long existing battle between ranchers who won land adjacent to the rivers and the citizens who believe everyone has a right to enjoy the rivers and the game therein. Over one hundred citizens most of which were from Uvalde and members of the Sportsman Association attended the trial held at the American Legion Lodge in Knippa,texas. The riverhunting issue gained much public attention when the recently elected State Representative, Gerald Geistweidt, attempted to present a bill to the legislature that would declare the riverbeds in the public rivers of the State of Texas game sancturaries. The proposed law would thus have made it illegal to take firearms into the river. Geistweidt was forced to come to Uvalde and then apologized to a large number of citizens who were against his proposed law. He stated then he had based himself on a plea from several Uvalde ranchers who had asked for his help in keeping hunters off the river. Geistweidt backed off and never presented his proposed law to the legislature as a result of this confrontation. The proclamation by which “The Uvalde Five’’ were charged with was one that was enacted some 16 years ago under the asuspices that the game in our state must be protected. Attorney Rogelio Munoz stated that this proclamation was one initiated by ranchers to keep people off the public rivers and serve their personal interests—not for the conservation of game.’’ While Uvalde County Judge Leo Darley was in office there was no problem for riverhunters because Darley believed the law was unconstitutional. He believed that since there were no defined river boundaries (and that it was impossible to survey every piece of riverbed) that his court could never find out if a man was guilty or not. Representative Geistweidt and a change in County Judge and three new County Commissioners, plus a greater popularity in hunting has given the issue a new dimension.
