Topeka ft S nti Fe. suiting for an injunction restraining the latter road from discriminating in favor of the Denver Ik Rio Grande. The decision ol Judge Hallett was against the ¡Denver ft New Orleans, and the injunction was prrempioril y refused. The ground upon which the injunction was a»ked was no evidently insufficient that a refuta) was inevitable. The suit was not to maintain existing relations but to establish entirely new one» This was as re sonable as it would I e fora merchant, having no previous business relations with ano Iler merchant, to bring suit to compel a partnership in an established business on terms fated by him-•elf. Indeed, the case would be parallel if the merchant bringing suit should have just entered bus-i cis. and the defendant should have, by yean of ndustry and enterprise, built up a large trade which the envious beginner desired to share. The absurdity ot such , I reposition, its unfairness and illegality were at once apptrent. The Judge, therefore, decided that as it was 'he purpose of an injunct-
